Pakistan mein khula ka process family court mein shuru karne ke liye, ek aurat ko apne shohar se talaq lene ke liye qanooni tareeqe se guzarna parta hai. Yahan par poora khula ka process Urdu mein tafseel se bayan kiya gaya hai:
1. Dawa Dakhil Karna (Case File Karna)
Aurat ko sabse pehle apne ilaqay ki family court mein ek khula ka dawa (suit for dissolution of marriage) dakhil karna hota hai. Is ke liye zaroori documents yeh hain:
- Nikah Nama ki copy
- CNIC (Shanakhti Card) ki copy
- Shohar ka CNIC ya uska pata
- Shadi aur talaq ki wajah likhna (reason for khula)
Agar koi aur saboot ya gawah hain jo talaq ka case mazid mazboot bana sakein, to wo bhi shaamil kiye ja sakte hain.
2. Court Notice aur Shohar ka Jawab
Jab case file ho jata hai, to court shoher ko ek notice bhajti hai ke wo court mein hazir ho kar apna jawab de.
- Agar shoher notice receive karne ke bawajood hazir na ho, to court ex-parte faisla de sakti hai.
- Agar shoher court mein aata hai, to phir dono parties ko sunne ke baad faisla hota hai.
3. Sulah Ki Koshish (Reconciliation Process)
Family court Pakistan ke qanoon ke mutabiq, sulah (reconciliation) ki koshish karti hai. Judge dono taraf ki batein sunti hai aur agar mumkin ho to rishta bachane ki koshish ki jati hai.
- Agar sulah ho jaye, to case khatam ho jata hai.
- Agar aurat apne faislay par qayam rahti hai, to khula ka faisla diya jata hai.
4. Khula Ka Faisla (Decree of Dissolution of Marriage)
Agar sulah na ho sake to court khula ka faisla sunati hai aur decree issue karti hai.
- Is process mein 3 se 6 mahine lag sakte hain.
- Aksar sooraton mein, aurat ko haq mehr ya diya gaya maal chorna parta hai.
- Agar shoher apni taraf se talaq de de to process tez ho sakta hai.
5. Talaq Nama aur Nadra Record Update
Jab khula ka faisla ho jaye, to:
- Union Council ya Arbitration Council ko yeh faisla bheja jata hai.
- Wahan se Talaq Nama (divorce certificate) issue hota hai.
- Nadra records update karwane ke liye talaq nama zaroori hota hai.
